These terms govern purchases on the online shop eccellenzeenogastronomiche.it. Before you confirm an order, we show you the total price, the shipping costs and a summary of the products. If you buy as a consumer, the protections of the Consumer Code (Legislative Decree 206/2005) also apply, and these terms do not reduce them.
1. Who sells
The seller is Imperato Giovanni, trading as "Eccellenze Enogastronomiche", Via Scialli 38, 84019 Vietri sul Mare (SA), VAT number 02879800650, telephone +39 335 820 7138, email info@eccellenzeenogastronomiche.it. The other business details are in the Legal notice.
2. Who they apply to
These terms apply to distance purchases made on the site by consumers, that is, by people who buy for purposes outside their trade or profession (Art. 3 of the Consumer Code). Those who buy with a VAT number can order and receive an invoice [TO BE CONFIRMED: sales to customers with a VAT number and terms for restaurateurs and wine shops, points A7 and D11]; withdrawal and the guarantee of conformity in the manner provided for consumers do not apply to those who buy for their business.
To place an order you must be of legal age. The site is in Italian and the contract is concluded in Italian.
3. Products and information
Each product page gives the product name, the producer, the size and the price. Descriptions and photos serve to present the product: colour, vintage or appearance may differ slightly from what is shown.
Information on foods. The mandatory information required by Regulation (EU) No 1169/2011 (name, ingredients, allergens, quantity, best-before or use-by date, storage conditions, producer or packer, origin where required, alcohol content for beverages) is shown on the label of the product you receive. Where we also give it on the product page, we do so for information only. In case of any difference, the label on the packaging prevails. If you have allergies or intolerances, always read the label before consumption; for wines, remember that they normally contain sulphites.
Availability. Products are sold while stocks last. If, after the order, a product is no longer available, we will let you know immediately and, if you do not accept an equivalent product, we will refund what you have already paid for that product.
4. Prices and VAT
Prices are in euro and include VAT at the legal rate for each product. Shipping costs are not included: you can see them in the cart and in the summary, together with the total, before you confirm the order. Shipping is free above a minimum order amount [TO BE CONFIRMED: free shipping threshold and rates, point A1].
If a price is evidently wrong (for example, an obvious typing error), we will contact you before processing the order, and you can confirm it at the correct price or cancel it at no cost.
For deliveries outside Italy, where offered, the applicable taxes and customs charges are shown before payment or remain payable by the recipient, as stated in the cart [TO BE CONFIRMED: countries served and tax treatment of foreign shipments, point A2].
5. How you order and when the contract is concluded
- You choose the products and add them to the cart.
- At checkout you enter or confirm your details, the delivery address, the shipping method and the payment method. Before paying, check the summary and correct any errors; for orders containing alcoholic beverages, we ask you for a declaration that you are of legal age [TO BE CONFIRMED: declaration at checkout, point B4].
- You accept these terms and confirm with the "Confirm and pay" button: by doing so, you are obliged to pay for the order [TO BE CONFIRMED: button label compliant with Art. 51, paragraph 2, of the Consumer Code].
- You receive an order confirmation by email, with a summary of the products, price, costs and delivery details. The contract is concluded when we send you the order confirmation.
You can find your order again in your personal area if you have an account. We recommend that you keep the confirmation email and print or save these terms.
6. Payment
The available payment methods are shown at checkout [TO BE CONFIRMED: methods active at launch (card, PayPal, bank transfer), point A4].
- Card and PayPal: payment is handled by the service provider over a secure connection; we neither see nor store your card details. The amount is charged when payment is confirmed.
- Bank transfer: we send you the bank details. We prepare the shipment after receiving the payment; if payment does not arrive within the deadline we give in the confirmation email [TO BE CONFIRMED: deadline for bank transfer], we may cancel the order.
We issue an invoice if you request it when ordering, stating your VAT number or tax code and recipient code [TO BE CONFIRMED: invoice request at checkout, point A7].
7. Shipping and delivery
We ship by tracked courier to the address you give in the order. Couriers, rates, countries served and preparation and delivery times are on the Shipping and returns page. When the parcel is dispatched, you receive the tracking code by email.
Unless otherwise agreed, we deliver without undue delay and in any case within 30 days of the conclusion of the contract (Art. 61 of the Consumer Code). If we do not meet the deadline, you may ask us to deliver within an additional reasonable period and, failing that, terminate the contract and obtain a refund (Art. 61).
Risk of loss or damage. Until you, or a third party you have designated other than the courier, take physical possession of the parcel, the risk is ours (Art. 63 of the Consumer Code).
On delivery. Check that the packaging is intact. If it is damaged or tampered with, accept the parcel with a written reservation on the courier's document and write to us immediately, attaching photos of the parcel and of the product [TO BE CONFIRMED: time limit and procedure for damaged parcels, point A3]. If you are not present, the courier follows its own delivery procedure [TO BE CONFIRMED: procedure if the recipient is absent, point A3].
8. Alcoholic beverages
The sale of alcoholic beverages is restricted to people of legal age. By placing the order you declare that you are at least 18 years old [TO BE CONFIRMED: declaration at checkout, point B4]. We do not deliver alcoholic beverages to minors and we reserve the right to cancel the order, with a refund, if we have reason to believe that the recipient is a minor.
9. Right of withdrawal
If you buy as a consumer, you may withdraw within 14 days of receiving the products, without giving a reason. Some products are excluded, for example those that risk deteriorating or expiring quickly and sealed products that cannot be returned for hygiene reasons once opened (Art. 59 of the Consumer Code). Time limits, procedure, return costs, refund and the model form are on the Right of withdrawal and returns page.
10. Legal guarantee of conformity
The seller is liable for lack of conformity of the goods that becomes apparent within two years of delivery (Art. 128 et seq. of the Consumer Code). The defect is presumed to have existed at the time of delivery if it becomes apparent within one year, unless proven otherwise or incompatible with the nature of the goods. For food products, examples of lack of conformity are a product that differs from the one ordered, is spoiled, has been opened or has damaged packaging that compromises the contents, or has already expired.
If there is a lack of conformity, you are entitled to have the goods brought into conformity by repair or replacement; if this is impossible or disproportionately burdensome, or if the problem persists, you are entitled to an appropriate price reduction or to termination of the contract with a refund. The costs of the remedy are borne by us. To activate the guarantee, write to info@eccellenzeenogastronomiche.it, stating the order number and attaching photos.
The guarantee does not cover deterioration resulting from incorrect storage or use after delivery, contrary to the indications on the label.
11. Intellectual property rights
The texts, images, trademarks and graphics of the site belong to the seller or to their respective owners (including the producers) and may not be copied or reused without authorisation, subject to the limits of the law. The names of the producers and products mentioned are used to describe the products for sale.
12. Liability
The seller is liable within the limits of the law. Nothing in these terms excludes or limits the rights that the law grants the consumer in a mandatory way. We are not liable for delays or failed deliveries due to causes beyond our control (for example exceptional events, strikes or road blockages), which we will communicate as soon as we become aware of them.
13. Personal data
We process your data as explained in the Privacy notice; cookies are described in the Cookie policy.
14. Complaints and out-of-court dispute resolution
Complaints should be sent to info@eccellenzeenogastronomiche.it and will receive a reply within a reasonable time.
The consumer may have recourse to an alternative dispute resolution (ADR) body listed in the register kept by the Ministry of Enterprises and Made in Italy (Art. 141 et seq. of the Consumer Code). The seller [TO BE CONFIRMED: whether or not it undertakes to use an ADR body for disputes with consumers]. Since 20 July 2025 the European online dispute resolution (ODR) platform has been closed, so it is no longer possible to submit complaints through it.
15. Applicable law and competent court
The contract is governed by Italian law. If you are a consumer, for any dispute the competent court is, as a matter of mandatory law, that of the place where you have your residence or domicile, if it is in Italy (Art. 66-bis of the Consumer Code). If you live in another country of the European Union, the mandatory consumer protection rules of your country of residence remain unaffected.
16. Changes
We apply the terms in force on the date of the order, shown at the top of this page. Any changes apply only to subsequent orders.
